In this masterclass, we are aiming to demystify the Transfer of Undertakings (Protection of Employment) Regulations 2006. The TUPE Regulations are notoriously complicated, and a failure to understand the circumstances in which they apply and the procedural requirements to ensure compliance can prove costly for businesses.
We will be looking at the following key questions:
- When is there a relevant transfer?
- What is a service provision change?
- Who and what transfers?
- When and with whom do we inform and consult?
- Can affected employees be dismissed because of the transfer?
- Can we change the contracts of affected employees?
We will also be looking ahead at the proposed reforms to TUPE, due to take effect in January 2014.
The masterclass is designed to examine the topic of TUPE in greater depth. The format is informal and interactive; you will be able to ask questions and to share your experiences with other attendees. A degree of previous experience and knowledge of HR matters will be assumed, so the session is probably not suited to very junior HR practitioners or line managers.
