    What is the difference between Debt Collection and Debt Recovery?

    Debt Collection Agencies can be instructed to seek recovery as an alternative to pursuing a debtor through the Courts.  These agencies do not have any legal powers and cannot do anything different to the original creditor but will use letters, phone calls, texts or email and may even attend a debtor’s property to try and obtain payment.  They do not, however, have a right to seize any property or have a legal entitlement to recover the debt unless they bring an action through the Court.

    Taking debt recovery action through the Courts means a creditor has a legal right to payment of that debt (if a County court Judgment is granted) and if payment is still not made, legal enforcement officers can then enforce the debt if necessary by seizing goods from a debtor’s property
